1. Introduction

These General Terms and Conditions govern the sale and provision by Travel Setter S.r.l. of:

• package holidays;
• tourism services;
• stays in private villas and properties;
• concierge services;
• bespoke experiences;
• corporate services;
• private and corporate events.

2. Definitions

A Client is any individual or legal entity purchasing or requesting services from Travel Setter.

A Supplier is any third party involved in providing services, including but not limited to:

• hotels;
• villas;
• airlines;
• transport providers;
• guides;
• restaurants;
• transfer companies;
• event organizers.

3. Requests and Quotations

All quotations:

• are valid only for a limited period;
• remain subject to availability;
• may be modified prior to confirmation.

Travel arrangements shall be deemed confirmed only upon written acceptance of the quotation and receipt of the required payments.

4. Payments

Unless otherwise specified in writing or agreed contractually:

• a deposit of 30% is due upon confirmation of the booking;
• the balance is due no later than 30 days prior to arrival or service delivery.

For bookings confirmed less than 30 days before arrival or service delivery, full payment may be required immediately.

Failure to make payment may result in cancellation of the booking.

5. VAT Regime

Where applicable, transactions may be subject to the special VAT scheme for travel agencies pursuant to Article 74-ter of Italian Presidential Decree No. 633/1972.

VAT shall be applied in accordance with current tax legislation.

6. Amendments Requested by the Client

Any amendment requested after confirmation is subject to:

• supplier availability;
• additional costs;
• penalties imposed by the relevant supplier.

7. Withdrawals and Cancellations

In the event of withdrawal or cancellation by the Client:

• up to 31 days before arrival or service delivery: loss of the deposit paid;
• from 30 days before arrival or service delivery: penalty equal to 100% of the total confirmed amount.

Any higher penalties imposed by airlines, villas, accommodation providers, or other partners shall remain applicable.

8. Villas and Private Properties

Specific conditions relating to villas and private properties shall be communicated on a case-by-case basis.

The following may be required:

• security deposits;
• additional guarantees;
• acceptance of the property's internal regulations.

The Client shall be liable for any damage caused to the property.

9. Concierge Services

Travel Setter acts as organizer and intermediary for services supplied by third parties.

The availability of experiences, restaurants, events, private visits, and exclusive services cannot be guaranteed until final confirmation has been received.

10. Travel Documentation

It is the sole responsibility of the Client to verify the validity and adequacy of:

• passports;
• identity documents;
• visas;
• vaccination requirements;
• health requirements;
• entry restrictions applicable to the destination country.

Any inability to travel due to invalid or insufficient documentation shall not entitle the Client to any refund.

11. Insurance

Travel Setter strongly recommends the purchase of comprehensive travel insurance covering:

• trip cancellation;
• medical assistance;
• medical expenses;
• baggage;
• personal liability.

12. Force Majeure

Travel Setter shall not be liable for any failure to perform obligations resulting from unforeseeable or unavoidable events, including but not limited to:

• natural disasters;
• war;
• epidemics;
• strikes;
• government restrictions;
• public health emergencies;
• extreme weather events.

13. Liability

Travel Setter's liability shall be limited to the extent permitted under Italian law and any regulations applicable to package travel arrangements.

The organizer's liability shall not exceed the limits established by applicable international conventions governing individual services.

Travel Setter relies upon carefully selected third-party suppliers for the provision of certain services.

Except where otherwise required under mandatory package travel regulations, Travel Setter shall not be held liable for failures, amendments, delays, cancellations, or interruptions attributable exclusively to third-party suppliers.

14. Complaints

Any complaint should be communicated promptly during the trip or service delivery.

Subsequent complaints must be submitted in writing within ten (10) days from the end of the services provided.

15. Privacy

Personal data shall be processed in compliance with the GDPR and applicable Italian legislation.
